  1. Introduction

These General Terms and Conditions (hereinafter T&C) contain the conditions for the use of the service available on the zamac.hu website (hereinafter: online store) by the user (hereinafter: User). The technical information required for the use of the online store, which is not contained in these GTC, is provided by the information available in the online store. By using the online store, the User acknowledges and accepts the provisions of these General Terms and Conditions.

4.1. Responsibility

The User may use the website solely at his own risk and accepts that zamac.hu shall not be liable for material or non-material damages arising during use, in addition to liability for breach of contract caused intentionally, through gross negligence, or criminally, as well as damage to life, limb, or health. zamac.hu excludes all responsibility for the behavior of website users and that the User is fully and exclusively responsible for his own behavior. The User is obliged to ensure that, when using the website, he does not directly or indirectly violate the rights of third parties or the laws. The Service Provider is entitled, but not obliged, to check the content (such as comments) that may be made available by the Users during the use of the website, and zamac.hu is entitled, but not obliged, to look for signs of illegal activity with respect to the published content and assumes no responsibility for them.

4.2. Copyrights

The entire website (texts, images, graphic elements, etc.) is protected by copyright, so it is forbidden to copy, modify or distribute it for commercial purposes!

  1. Shopping on the website

5.1. Order process

The website provides users with product presentations and online ordering. The User can browse the website using the menu items. The products are listed in a category system. By clicking on the name of the category, you can see the list of products included in it. If all the products in a given category do not fit on one page, you can use the numbers above and below the products to page. From the product list, the detailed product page can be accessed by clicking on the product name, here you can find out about the detailed characteristics and price of the product you want to order. The selected product can be placed in the basket with the help of the "Add to basket" button, the required number of pieces can be set next to the button. The User can check the contents of the basket at the top right, using the basket symbol or the 'Basket' button. Here you can change the quantity of the product in the basket you want to order, or you can delete the given item with the X . The User can continue the purchase process by clicking the 'Proceed to checkout' button. The User is responsible for keeping access data confidential. The User is responsible for updating his data and is obliged to notify the Service Provider if he becomes aware that his data has been misused by a third party. As the next step of the order, the User must choose the payment and delivery method that suits him. With the help of a summary page, the User can check all the previously entered data and the products they want to order and their quantities. In case of data entry errors, you can use the pencil icon to correct the entered data. If you find everything suitable, you can finalize your order using the Submit Order button. You will receive confirmation of this on the website or by e-mail. If you notice incorrect data after the order has been recorded (e.g. in the confirmation e-mail), you must report it to the Service Provider immediately, but no later than within 24 hours. Regardless of the intention to order, the User can log in via the My Account menu item. After logging in, a Change data menu item appears, where you can change the data you entered during registration, as well as the data of your placed order and track its status.

5.2. Binding offer, confirmation

The Service Provider informs the User about the confirmation within 48 hours. If the User does not receive this confirmation within 48 hours, the User is released from his obligation to make an offer and is not obliged to take delivery of the ordered products. The confirmation e-mail contains the data provided during the purchase, the order data, the name and price of the product(s) ordered, the chosen payment and delivery methods, the order number, as well as the User's comments about the order.

5.3. Creation of the contract

It is possible to conclude the contract in Hungarian. Placing an order is considered a contract concluded electronically, which is subject to the provisions of Act CVIII of 2001 on certain issues of electronic commercial services and services related to the information society. the provisions of the law are applicable accordingly. The contract falls under the scope of Government Decree 45/2014 (II.26.) on the detailed rules of contracts between the consumer and the business, and takes into account the provisions of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights. The contract is concluded after the Service Provider sends the User a second email (separate acceptance email) within 48 hours in addition to the automatic confirmation email, with which the User's offer is accepted, and thus the contract is concluded upon receipt of a separate email regarding the acceptance of the offer by the Service Provider and not upon receipt of the automatic order confirmation email within 48 hours.

5.4. Registration of the contract

The contract concluded via the website is not considered a written contract, the Service Provider does not file it, and it is not accessible afterwards.

5.5. Account

We issue our invoices using the szamlazz.hu system. You will receive this in print together with the package or by e-mail after ordering.

5.6. Payment

Online bank card payments are made through Stripe's electronic payment processing system.
Stripe is a technology company that builds economic infrastructure for the Internet. It helps businesses of all sizes, from startups to state-owned enterprises, accept payments and manage their businesses online.

Stripe's online payment system enables payment with the following bank cards and digital wallets (Hungarian-related list):

Payment steps

  • You have selected the goods and/or services for which you wish to pay by bank card.
  • After that, you are transferred to this interface, where you can learn about bank card payment and check the data of the transaction you want to start.
  • after pressing the button, you will be redirected to Stripe's secure payment guarantee page, where you need to enter your card details to start the payment.
  • After entering the card data, the t"xxxx HUF payment"you can start the transaction by clicking the start transaction button.
  • Stripe starts debiting the Cardholder's account with the amount of the transaction.
  • In the event of a problem, the transaction page informs you of its status and gives you an additional option to change the data.
  • After a successful payment, you will automatically return to our bank card payment closing page, where you will receive feedback on the result of the transaction.
  • You can cancel the transaction at any time by clicking the Cancel icon next to our company logo.

If you are not redirected from the payment page to this page, the transaction is not yet considered unsuccessful. If you click on the browser's "Back" or "Refresh" button on the payment page, or close the browser window before being redirected to this page, the payment may be considered unsuccessful, but not in all cases.

We provide information about the result of the successful transaction by email. Stripe's transaction page provides information about an unsuccessful transaction.

Secure bank card payment solution provided by Stripe

Security is based on the separation of data.
The Webstore receives information about the order from the customer, and Stripe only receives the card data required for the payment transaction on the TLS-encrypted payment page.
The Web Store is not informed of the data content of the payment page, they can only be accessed by Stripe. After payment, you will be informed about the result of the transaction on the website of the Webstore. To pay by card, your internet browser must support SSL encryption. The consideration for the purchased goods/services, the amount paid, is immediately blocked on your card account.

5.7. Acceptance options, Delivery Delivery methods:

5.7.1. COURIER SERVICE

Our parcels are currently delivered by GLS Hungary, the Packeta courier service, and the MPL courier service only during working hours.  The customer can specify the address of his workplace as a delivery address upon prior consultation.


  1. Warranty

6.1. Accessories warranty

In the event of defective performance by the Service Provider, the User may enforce a warranty claim against the company in accordance with the provisions of Act V of 2013 on the Civil Code. In the case of a consumer contract, the User who qualifies as a Consumer can assert his warranty claims for product defects that already existed at the time of delivery of the product within a 2-year statute of limitations from the date of receipt. After the two-year limitation period, the User can no longer assert his accessory warranty rights. In the case of a contract not concluded with the Consumer, the User may enforce his warranty claims within the 1-year limitation period from the date of receipt. The User may - at his or her choice - make use of the following accessory warranty claims: He may request repair or replacement, unless the fulfillment of the requirement chosen by the Buyer is impossible or would involve disproportionate additional costs for the company compared to the fulfillment of other requirements. If the user did not or could not request the repair or replacement, he can request a proportional reduction of the compensation or the user can repair the defect at the company's expense, or have it repaired by someone else or - as a last resort - withdraw from the contract. The User may switch from his chosen accessory warranty right to another, but the cost of the switch is borne by the User, unless it was justified or the company gave a reason for it. The User is obliged to report the error immediately after its discovery, but no later than within two (2) months from the discovery of the error. The User can enforce his accessory warranty claim directly against the company. In the event of a defect detected within six months of delivery (that is, after delivery or acceptance), it must be assumed that the defect already existed at the time of delivery, unless this assumption is incompatible with the nature of the defect or the nature of the product. The Service Provider is only released from the warranty if it refutes this presumption, i.e. it proves that the defect of the product occurred after it was handed over to the User. Based on this, the Service Provider is not obliged to accept the User's objection, if he can properly prove that the cause of the error is the result of improper use of the product. However, the burden of proof reverses six months after the performance, i.e. in the event of a dispute, the User must prove that the defect already existed at the time of performance.

6.2. Product warranty

Product warranty can only arise in the event of a defect in a movable thing (product). In this case, the User who qualifies as a Consumer - according to his choice - according to 6.1. you can enforce your right or product warranty claim specified in point. As a product warranty claim, the User may only request the repair or replacement of the defective product. The product is considered defective if it does not meet the quality requirements in force at the time it is placed on the market or if it does not have the properties described by the manufacturer. The User may assert a product warranty claim within two (2) years from the date the product was placed on the market by the manufacturer. After this deadline, you will lose this right. The User may exercise his product warranty claim only against the manufacturer or distributor of the movable object. The User must prove the defect of the product in the event of a product warranty claim. The manufacturer (distributor) is exempted from its product warranty obligation only if it can prove that: the product was not manufactured or placed on the market as part of its business activities, or the defect was undetectable according to the state of science and technology at the time of placing it on the market, or the product defect results from the application of legislation or mandatory official regulations. It is sufficient for the manufacturer (distributor) to prove one reason for the exemption. Due to the same fault, claims for accessory warranty and product warranty cannot be asserted at the same time, parallel to each other. However, in the case of successful enforcement of a product warranty claim, the User may assert his accessory warranty claim for the replaced product or repaired part against the manufacturer.

6.3. Warranty

151/2003 on the mandatory warranty for certain consumer durables in relation to the mandatory warranty for certain consumer durables. (IX. 22.) Government decree contains regulations.

Products with a sales price of HUF 10,000 or less are not covered by the mandatory warranty - based on the law.

The (objective) scope of the decree only applies to the products sold within the framework of the new consumer contract concluded in Hungary and listed in the annex to the decree. With regard to the consumer durables listed in the annex to the government decree, the mandatory warranty is 1 year, the starting date of which is the day the product is handed over to the Consumer or, if the service provider or its agent performs the commissioning, the day of commissioning. The company is exempted from warranty obligations only if it proves that the cause of the defect arose after performance. Due to the same error, the User cannot assert a claim for accessory warranty and warranty, or a claim for product warranty and warranty at the same time, in parallel with each other, otherwise, the User's rights arising from the warranty are in accordance with Article 7.1. and 7.2. regardless of the rights defined in point

  1. Complaint handling procedure

The goal of our online store is to fulfill all orders in good quality and to the complete satisfaction of the customer. If the User still has any complaints about the contract or its performance, the User can submit his complaint to the following contact details:

The service provider examines the verbal complaint immediately and remedies it as necessary. If the customer does not agree with the handling of the complaint, or the immediate investigation of the complaint is not possible, the Service Provider will immediately record the complaint and its position on it and hand over a copy of it to the customer.

The Service will respond to the written complaint in writing within 30 days. He gives reasons for his position rejecting the complaint. The record of the complaint and a copy of the response will be kept by the Service Provider for five years and presented to the inspection authorities upon their request.

The Conciliation Board is responsible for settling consumer disputes outside of court proceedings. The task of the conciliation board is to attempt to reach an agreement between the parties in order to resolve the consumer dispute, and in the event of this being unsuccessful, it makes a decision on the matter in order to ensure simple, fast, efficient and cost-saving enforcement of consumer rights. At the request of the consumer or the Service Provider, the conciliation board provides advice on the rights and obligations of the consumer.

In the event of a cross-border consumer dispute related to an online sales or online service contract, the Conciliation Board operating under the Capital Chamber of Commerce and Industry is solely responsible for the procedure.

In the event of a complaint, the Consumer can use the EU online dispute resolution platform. Using the platform requires a simple registration in the European Commission system,by clicking here. After that, after logging in, the consumer can submit a complaint via the online website, which has the following address:https://ec.europa.eu/odr

The service provider is obliged to cooperate in the Conciliation Board procedure. As part of this, you must send your response to the conciliation board and ensure the participation of the person authorized to establish a settlement at the hearing. If the company's seat or location is not registered in the county of the chamber that operates the territorially competent conciliation body, the company's obligation to cooperate extends to offering the possibility of concluding a written agreement that meets the consumer's needs.

8.1. General Terms and Conditions, modification of prices

The Service Provider may modify these Terms and Conditions, the prices of the products sold on the website and other indicated prices at any time with non-retroactive effect.

8.2. Technical limitations

Shopping on the website presupposes the User's knowledge and acceptance of the possibilities and limitations of the Internet, with particular regard to technical performance and errors that may arise. The Service Provider is not responsible if any operational error is detected in the internet network, which prevents the operation of the website and the purchase.

8.3. Privacy policy

zamac.hu only uses the data provided by the customer in its own invoicing and accounting system. It does not make them accessible to third parties. The customer's data, name, address, telephone / mobile phone contact information, will be transferred to the delivery company at the time of delivery. Confidentiality of data is provided for in a contract between zamac.hu and the delivery company. In the case of every purchase, zamac.hu acts in accordance with the Data Protection Act regarding the confidential handling of data provided to it. At the request of the customer, zamac.hu, which may be in the form of a letter sent by post or electronic mail, modifies, presents, or deletes it according to the request contained therein. They form an exception to this, for which e.g. The Accounting Act obliges the Service Provider (data to be filled in when issuing an invoice). In case of acceptance of the above, which is also a condition for purchasing on the zamac.hu website, the customer agrees to the Service Provider regularly sending him a newsletter and other information related to his online store to the specified e-mail address.

  1. Warranty

9.1. Right to withdraw from purchase

Right of withdrawal (Government Decree 45/2014.(II.26.))

According to legislation, consumers have the right to withdraw without reason. The withdrawal/termination period expires 14 days after the day on which you or a third party other than the carrier designated by you receives the product. The consumer can also exercise his right of withdrawal in the period between the date of conclusion of the contract and the receipt of the product. If you wish to exercise your right of withdrawal/termination, you must send a clear statement containing your intention to withdraw/terminate (e.g. by post, fax or electronic mail) to the following address: Ilona Anita Váicsné Scholcz – 6500 Baja, Parti u. to address 7. For this purpose, you can also use the attached withdrawal/termination statement sample. You exercise your right of withdrawal/termination within the deadline if you send your withdrawal/termination statement before the deadline specified above. The product must be returned to the consumer immediately, but no later than within 14 days from the notification of cancellation. Legal effects of withdrawal/termination: If you withdraw from the contract, the Service Provider will immediately, but no later than within 14 days from the receipt of your withdrawal statement, refund all the compensation provided by you, including the cost of transport (with the exception of the additional costs incurred due to the fact that you used a transport method other than the cheapest standard transport method offered by us During the refund, we will use the payment method used during the original transaction, so we will return the amount to the specified bank card. If the payment was made by cash on delivery, we will ask you to provide the bank account number in order to be able to return the amount to your account product, or you have not confirmed that you have returned it: the earlier of the two dates must be taken into account. You bear the direct cost of returning the product - the shipping cost - you can only be held responsible for the decrease in value of the product, if it occurred due to use beyond what is necessary to determine the nature and properties of the product.

9.2. Cancellation of the order by the webshop in the absence of feedback

If the Customer does not pay or transfer the full price of the ordered product(s) and the shipping cost to the Webshop within 3 working days from the finalization of the purchase, the Webshop may unilaterally cancel the sale.

Our webshop was made available to us by Shopify.

They provide us with the necessary platform for e-commerce, which enables our customers to use our services and purchase our products.

  1. Final provisions

The online content of the online store, together with texts, graphics, photographs, animated photographs, films, illustrations and, in some cases, sounds and programs, are the property of zamac.hu. These contents are protected by copyright. Their use is only permitted with the express permission of zamac.hu. The Service Provider reserves the right to unilaterally modify the General Terms and Conditions in whole or in part at any time, upon notification to the User. The General Terms and Conditions and any amendments thereto shall enter into force upon publication.

  1. 1.1. The GTC contain the general conditions of the legal relationship between the Service Provider and the customer entering into a contractual relationship with it. Regarding the issues not regulated here, the Hungarian legislation and official regulations in force at all times regarding the activities of the Service Provider's online store, especially in the Civil Code, CVIII of 2001 on certain issues of electronic commercial services and some services related to the information society.
